Chris: Why are these home selling at premiums to their assessments? Especially, those north of 3mm?!

Don't these buyers know that they are supposed to demand a price BELOW the assessment?

Aren't the buyers going to feel really foolish when the market collapses and their market values are down 20% from their purchase prices a year from now?

Yep it is ugly.I clipped the paragragphs from an article about AZ property values (and national trends). The house mentioned below cost $265,000 in the Phoenix area, and sold for $65,300, a 75% decline in value.

a few things on a short sale
First off there is not deal until all the lenders agree to and signs off on the contract, this can take months to occur if the short sale even happens; majority of short sales fail for one reason or another

also until the lender gets the offer, and does an appraisal you are not even close to a deal , so when you place an offer on a short sale you must make its explicit in the offer the seller has x months to obtain lender approval or you can walk and get back your earnest deposit usually people place a three month time limit

the lender can also change the price to release the home for sale for example you and the seller agree to 100K then the lender does an appraisal and decides they will only do the deal at 150K , take it or leave it

That's correct. You should still have one done so you know exactly what you are getting, but you typically won't have the opportunity to bow out or renegotiate depending on the results.

I do believe "as is" will apply. However, I suggest you ask them to knock off more money b/c of the clean up costs.
