Your house is going to sheriff sale. That is an opportunity for someone to buy the property straight out for cash. Usually the present owners or any one else does not have that kind of cash so the property is 'sold' back to the bank. They pay transfer taxes on the property when it reverts back to them. This is the beginning of the redemption period. It used to be standard that the redemption period lasts 6 months after the sheriff sale. If you can come up with the cash within that time, you can redeem the property. You can try to sell the property during this time. Obviously the market is not good so it might go for considerably less than what you owe and the bank is not likely to work on a short sale if they've already paid the transfer taxes. If you do a short sale, the bank will probably 1099 you for the deficiency meaning you'll have to pay taxes on the amount as if it was income. That could be a lot. You can still try to negotiate if you call them and tell them you want to work out something. Lots of banks are negotiating heavily with anyone who wants to work something out. If not, to answer your original question, you don't have to leave until you get put out. Some banks are writing off some mortgages as bad debts so they will never come to get the house. This is happening in Detroit for instance because it's not likely the bank can resell the property for a decent price. Some banks are not taking the houses after 6 months because it costs them quite a bit to secure the property if they think it will remain vacant for a long time. When they do take control, they can't legally just throw you out. They have to evict you through the courts. You will then have at least 30 days notice. If I were you, I'd have a back up plan on where to go if you have to move quickly. Maybe put some stuff in public storage for now. But then I wouldn't leave unless I get word that I have to leave.

Of course you do. Buying a short sale is no different than buying a home which is NOT a short sale, except that the real estate agent has considerably MORE work to do with a short sale, since lender negotiations are also required.
